While Trump and his gang claim that Iran is ready to accept the dictates of the United States, the reality is very different.
It seems that after the crazy man said that he had canceled the heavy blow he planned to inflict on Iran, “at the request of the Arab countries,” Trump succeeded in convincing the capital markets that he was in control of reality, even if it was a figment of his imagination. The price of oil plummeted and the stock markets soared on Monday, but it seems that the US president no longer controls the course of events. Shortly after announcing that Iran had asked to renew the negotiations and that yesterday they were already on the verge of renewal, Iranian Foreign Ministry spokesman Esmail Baqai was quick to deny the lie.
Iran did not seek to renew the talks, Baqai stressed in a briefing to journalists. According to him, “The only negotiations it is conducting now is with Oman on a temporary solution to the Hormuz issue.” According to Baqai, even if an agreement is reached between Oman and Iran, it does not mean that sailing in the Persian Gulf will be resumed until the United States fulfills all its obligations under the memorandum of understanding, including the withdrawal of its forces and the lifting of the blockade on Iran.
In practice, it seems that the negotiations on regulating the sailing in the Strait of Hormuz have undergone a very significant change.. In early April-May, Hormuz’s question was an integral part of the direct negotiations between the United States and Iran, and was intended to serve as a bargaining chip and a precondition for discussing the nuclear issue. Since then, Iran has succeeded in detaching it from all issues and setting it as a bilateral discussion between it and Oman. While the U.S. is in the position of observer, waiting to see if and how the parties will resolve the dispute.
An agreement with Oman would prevent the United States from using Hormuz as a bargaining chip. Ostensibly, Trump will still be able to decide whether he accepts the terms of the agreement reached between Oman and Iran, or rejects them. But this is an imaginary possibility.
Iran demands complete and full sovereignty over the strait in a way that prevents free passage through it and turns it into a source of income and protects Iran
Oman proposes the existing model in the Strait of Malacca in East Asia: two transit routes, one within Omani territorial waters and open to free navigation, and the other in Iranian waters, where vessels would be required to ask Tehran for permission to transit. A later version of the Omani proposal, backed by the Gulf states, included a joint monitoring mechanism with “voluntary payments” to fund shipping safety and the environment – without Iran receiving exclusive control of the route.
Iran rejected both proposals, on the grounds that they did not meet its demands to ensure its national security. In their place, Tehran proposed a formula in which the entire entry route and a section of the southern exit route would pass through its territorial waters. In this way, it will be able to exercise effective supervision over most of the shipping traffic in the Strait. In a previous Iranian version, there was also talk of collecting official customs duties and prohibiting the passage of vessels to companies or countries that benefit from Iranian assets that have been frozen and are therefore not innocent.
Now the parties are trying to draw a new navigational map, in which there will be no separation between the two lanes, but rather a single, circular and shared route, in which each side will maintain its sovereignty. However, even this formula does not yet provide an explanation of what Iran’s powers will be, if and how much money shipowners will be required to pay for “sailing services” such as security, navigation and maintenance, and how the revenues will be distributed. And these are the relatively easy obstacles.
Iran has not ratified the UN Convention on the Law of the Sea, which provides for the free passage of all vessels (with certain restrictions) even when they cross the territorial waters of countries bordering the waterways, and without the need for the approval of those countries., Tehran says it is not bound by the articles of the treaty because they have never ratified it. Instead of the principle of ‘free passage,’ they demand the application of the principle of ‘innocent passage,’ which establishes a much more limited right of passage that can be suspended.”The “innocent crossing” allows Iran to stop and inspect ships passing through its territorial waters and oblige the vessel to request a passage permit. The larger the area of the strait falls under the Iranian model, the wider the distance between what Iran considers legal and what the United States and the European Union consider to be a free right of passage that cannot be denied. But Iran’s demand is for complete and complete sovereignty over the strait, just as the Suez Canal belongs to Egypt.
Iranian Foreign Minister Abbas Araghchi reported that the agreement with Oman is on the verge of completion. “The impression is that Iran now has an interest in accelerating and completing the negotiations on Hormuz. An agreement on it will open the economic air pipeline that it desperately needs, especially when regional conditions are tilted in its favor. The Gulf states have already proven their ability to block a large-scale military attack on it, and like Iran, they need the quick release of the cargo trapped in their ports. Saudi Arabia, Qatar, and the United Arab Emirates are in intensive contacts with Iran, and they are partners in contacts in Oman and are outlining the boundaries of the agreement with it. It can be assumed that any agreement reached between Iran and Oman, even if it gives Tehran more sovereign rights in the Strait of Hormuz, is preferable to the renewal of the war. And whatever will be acceptable to them will also be acceptable to Trump, who lacks options and has been beaten.

בפועל נראה כי המו”מ על הסדרת השיט במצר הורמוז עבר שינוי מאוד משמעותי.. בתחילת באפריל־מאי, הייתה השאלה של הורמוז החלק בלתי נפרד מהמו”מ הישיר בין ארה”ב לאיראן, ונועדה לשמש קלף מיקוח ותנאי מוקדם לדיון על סוגיית הגרעין. מאז הצליחה איראן לנתקו ממכלול הנושאים ולקבוע אותו כדיון בילטרלי בינה ובין עומאן. בעוד ארה”ב בעמדת המשקיף שממתין לראות אם וכיצד יפתרו הצדדים את המחלוקת.
הסכם עם עומאן ימנע מארה”ב להשתמש בהורמוז כקלף מיקוח. לכאורה עדיין יוכל טראמפ להחליט אם הוא מקבל את סעיפי ההסכם שיושג בין עומאן לאיראן, או דוחה אותם. אולם זאת אפשרות דמיונית.

עומאן מציעה את המודל הקיים במצר מלקה שבמזרח אסיה: שני נתיבי מעבר, האחד בתוך מים טריטוריאליים עומאניים ופתוח לשיט חופשי, והשני במים האיראניים, שבו יידרשו כלי שיט לבקש מטהראן רשות מעבר. גרסה מאוחרת יותר של ההצעה העומאנית, שזכתה לגיבוי של מדינות המפרץ, כללה מנגנון פיקוח משותף עם “תשלומים וולונטריים” למימון בטיחות שיט וסביבה – בלי שאיראן תקבל שליטה בלעדית בנתיב.
איראן דחתה את שתי ההצעות, בנימוק שאינן עונות על דרישותיה להבטחת הביטחון הלאומי שלה. במקומן הציעה טהראן נוסחה שבה כל נתיב הכניסה וקטע מנתיב היציאה, הדרומי, יעברו במים הטריטוריאליים שלה. כך היא תוכל להפעיל פיקוח אפקטיבי על רוב תנועת הספנות במצר. בגרסה איראנית קודמת דובר גם על גביית מכס רשמי ועל איסור מעבר לכלי שיט של חברות או מדינות שנהנות מנכסים איראניים שהוקפאו ועל כן אינן תמימות..
עכשיו הצדדים מנסים לשרטט מפת שיט חדשה, שבה לא תהיה הפרדה בין שני הנתיבים אלא יוסכם על נתיב אחד, מעגלי ומשותף, שבו ישמור כל צד על ריבונותו. ואולם גם הנוסחה הזו אינה מספקת בינתיים הסבר מה יהיו סמכויותיה של איראן, אם וכמה כסף יידרשו בעלי הספינות לשלם עבור “שירותי שיט” כגון אבטחה, ניווט ותחזוקה, וכיצד יחולקו ההכנסות. ואלה המכשולים הקלים יחסית.
איראן לא אשררה את אמנת האו”ם בדבר חוק הים, שקובעת מעבר חופשי לכל כלי השיט (במגבלות מסוימות) גם כשהם חוצים מים טריטוריאליים של מדינות הגובלות במעברי המים, ובלי צורך באישור המדינות האלה., טהראן אומרת כי אינה מחויבת לסעיפי האמנה משום שהם מעולם לא אישררו אותה. במקום עיקרון “המעבר החופשי” הם דורשים ליישם את עיקרון “המעבר התמים”, שקובע זכות מעבר מצומצמת בהרבה ושאותה אפשר להשעות. “המעבר התמים” מתיר לאיראן לעצור ולבדוק ספינות שעוברות במים הטריטוריאליים שלה ולחייב את כלי השיט לבקש אישור מעבר. ככל שייפול שטח גדול יותר מהמצר במסגרת המודל האיראני, כך יתרחב המרחק בין מה שאיראן מחשיבה חוקי ובין מה שארה”ב, האיחוד האירופי מחשיבות זכות מעבר חופשי שאין לשלול אותו. אך דרישת איראן היא לריבונות מוחלטת ומלאה על המצר כפי שתעלת סואץ היא של מצרים
