It is no secret that the Zionist Supreme Court supports the oppression of the Palestinians in its rulings.
It was Aharon Barak, the retired president of the Zionist Supreme Court, who said in a speech at a meeting of lawyers in Eilat that the Supreme Court serves as an umbrella against accusing Israel of war crimes.
He also said: “When Netanyahu suggested that I go to The Hague, I didn’t go to defend the government. I agreed to defend law and justice out of Zionism. In a situation where Israel is accused of genocide, then I – a Holocaust survivor – am also accused of genocide. I did everything I could in the conversations I had with the Prosecutor General in The Hague and his assistants, who got out of this whole thing,” Barak continued. “Not because I’m defending the Prime Minister, but because in my opinion an arrest warrant against the Prime Minister is an arrest warrant against the State of Israel.”[i]
Today, the Supreme Court continues to defend Israel’s crimes with greater vigor.
Judge Stein, in a Supreme Court hearing on the Yemeni field case, where the rape of a Palestinian detainee by Zionist soldiers was filmed, said yesterday (Monday) that “anyone who calls the State of Israel an apartheid state has no place to set foot in the State of Israel.” He said these words in a hearing on petitions filed by international humanitarian organizations, which Israel has banned from continuing to operate in the Gaza Strip and the West Bank. Israel rejected the organizations’ request for a permit that would allow them to continue to operate for the benefit of the Palestinian population.
The petitions were filed on behalf of three important organizations that have been operating in the territories for many years – Save the Children, a huge international organization that operates in dozens of countries around the world; the Italian organization CESVI; and the Swedish organization Diakonia. The three judges, Yael Wilner, Ruth Ronen, and Stein, accepted the state’s position that it is permissible to consider considerations of delegitimization. And that they have ties to the Islamic Relief organization, which was declared an illegal association in Israel in 2014, justify the state’s refusal.
In the hearing held yesterday on the petition for the admission of patients from Gaza for treatment in Israel, the High Court also focused on the criticism leveled at Israel and the IDF. Justices Alex Stein, Yael Wilner, and Yechiel Kasher ordered the deletion from the petition of the opinion of Dr. Amberin Salimi, an American gynecologist and urogynecologist with 30 years of experience, who volunteered for six weeks at the Nasser Hospital in Gaza.
In the opinion that the petitioners requested to submit to the High Court of Justice, Salimi described, among other things, pregnant women she met who suffered from severe malnutrition, a shortage of medicines and medical equipment, and babies with treatable defects who could not receive the necessary care. However, the judges focused on the criticism she made. The doctor claimed, among other things, that she had seen women who had been shot and injured and that infant formula found in the luggage of volunteers had been discarded by the Israeli army. In their decision, the judges wrote that after clarifying that the opinion “includes incorrect and offensive statements towards the State of Israel and its soldiers, the petitioners requested that this appendix be removed from the petition’s appendices, and this will be done.”
Five human rights organizations petitioned the High Court of Justice in November demanding that the state resume the evacuation of patients from the Gaza Strip to hospitals in the West Bank and East Jerusalem. According to the petitioners – Physicians for Human Rights, Gisha, Adalah, HaMoked for the Protection of the Individual, and the Association for Civil Rights – Israel is violating its obligations under Israeli and international law to protect the lives of Palestinians in the Gaza Strip, who are under its de facto control, especially due to the fact that Israel completely controls the movement of patients out of the Gaza Strip. “This is not a political or security decision, but a basic obligation to save human lives,” the organizations wrote in the petition.
In yesterday’s hearing, state representatives said that evacuation to third countries is a worthy alternative to the medical corridor to hospitals in Israel, even though only about ten percent of all evacuations for medical treatment outside Gaza are currently approved, compared to the situation before October 7, 2023 — while the health system in Gaza is collapsing. The petitioners emphasized that evacuation to third countries is far from meeting the needs in the Gaza Strip.
Mamdani during the New York mayoral election promised to arrest Netanyahu if he came to New York. But as is known, Netanyahu is thinking of visiting New York for a discussion at the UN. Mamdani said he would consult on whether he had the authority to order the arrest of the war criminal, and in the meantime, Trump announced that Netanyahu could not be arrested. This disgusting behavior is not surprising. After World War II, the United States and the Vatican helped Nazis emigrate to Latin America. The organization for the escape of senior Nazis was called the “Ratline.” Some well-known organizations such as the Catholic Church and the United Stated Government were involved in the Ratline.[ii],
בית המשפט העליון הציוני מסיר לגמרי את המסכה
אין זה סוד כי בית המשפט העלין הציוני תומך בדיכוי הפלסטינים בפסקי הדין שלו. היה זה אהרון ברק נשיא בדימוס של בית המשפט העליון הציוני שאמר בנאום של מפגש משפטנים באילת כי בית המשפט העליון משמש כמטריה נגד האשמת ישראל בפשעי מלחמה.
הוא גם אמר: “כשהציע לי נתניהו ללכת להאג, לא הלכתי כדי להגן על הממשלה. הסכמתי כדי להגן על המשפט והצדק מתוך ציונות. מתוך מצב שמאשימים את ישראל בג’נוסייד, אז מאשימים גם אותי – ניצול שואה – בג’נוסייד. עשיתי כל מה שיכולתי בשיחות שהיו לי עם התובע הכללי בהאג והעוזרים שלו, שירד מכל העסק הזה”, המשיך ברק. “לא משום שאני מגן על ראש הממשלה, אלא כי צו מעצר נגד ראש הממשלה הוא בעיניי צו מעצר נגד מדינת ישראל”[i]
כיום בית המשפט העליון ממשיך ביתר שאת את ההגנה על פשעי ישראל.
השופט שטיין בדיון בבית המשפט העליון על פרשת שדה תימן ששם צולם אונס של עציר פלסטיני על ידי החיילים הציונים, אמר אתמול (שני) כי “מי שקורא למדינת ישראל מדינת אפרטהייד, אין לו מקום לדרוך במדינת ישראל”. את הדברים אמר בדיון בעתירות שהגישו ארגונים הומניטריים בינלאומיים, עליהם אסרה ישראל להמשיך לפעול ברצועת עזה ובגדה המערבית. ישראל דחתה את בקשת הארגונים לקבלת היתר שיאפשר להם להמשיך ולפעול לטובת האוכלוסייה הפלסטינית.
העתירות הוגשו מטעם שלושה ארגונים חשובים שפועלים שנים רבות בשטחים – ארגון Save the Children, ארגון בינלאומי ענק שפועל בעשרות מדינות ברחבי העולם; הארגון האיטלקי CESVI והארגון השבדי דיאקוניה. שלושת השופטים, יעל וילנר, רות רונן ושטיין, קיבלו את עמדת המדינה כי מותר לשקול שיקולים של דה־לגיטמציה. וכי יש להם קשרים עם ארגון Islamic Relief, שהוכרז בישראל כהתאגדות בלתי חוקית כבר בשנת 2014, מצדיקים את הסירוב של המדינה.
גם בדיון שנערך אתמול בעתירה למען הכנסת חולים מעזה לטיפול בישראל התמקד בג”ץ בביקורת שהושמעה כלפי ישראל וצה”ל. השופטים אלכס שטיין, יעל וילנר ויחיאל כשר הורו להשמיט מהעתירה את חוות דעתה של ד”ר אמברין סלימי, גניקולוגית ואורוגניקולוגית אמריקאית בעלת 30 שנות ניסיון, שהתנדבה במשך שישה שבועות בבית החולים נאסר בעזה.
בחוות הדעת שביקשו העותרים להגיש לבג”ץ, תיארה סלימי בין היתר נשים הרות שפגשה וסבלו מתת־תזונה קשה, מחסור בתרופות ובציוד רפואי, ותינוקות עם מומים בני־טיפול שלא יכלו לקבל את הטיפול הדרוש. ואולם השופטים התמקדו בביקורת שהשמיעה. הרופאה טענה בין היתר שראתה נשים שנורו ונפצעו וכי פורמולה לתינוקות שנמצאה במטען של מתנדבים הושלכה על ידי הצבא הישראלי. בהחלטתם כתבו השופטים כי לאחר שהבהירו כי האמור בחוות הדעת “כולל אמירות בלתי נכונות ופוגעניות כלפי מדינת ישראל וחייליה, נאותו העותרים להוצאת נספח זה מכלל נספחי העתירה, וכך ייעשה”.
חמישה ארגוני זכויות אדם עתרו לבג”ץ בנובמבר בדרישה לחייב את המדינה לחדש את פינוי החולים מרצועת עזה לבתי חולים בגדה המערבית ובמזרח ירושלים. לפי העותרים – הארגונים רופאים לזכויות אדם, גישה, עדאלה, המוקד להגנת הפרט והאגודה לזכויות האזרח – ישראל מפרה את חובותיה לפי המשפט הישראלי והבינלאומי להגן על חיי הפלסטינים ברצועה, המצויים תחת שליטתה בפועל, במיוחד בשל העובדה שישראל שולטת לחלוטין בתנועת החולים אל מחוץ לרצועה. “אין מדובר בהחלטה מדינית או ביטחונית, אלא בחובה בסיסית להציל חיי אדם”, כתבו הארגונים בעתירה.
בדיון אתמול אמרו נציגי המדינה כי הפינוי למדינות שלישיות מהווה חלופה ראויה למסדרון הרפואי לבתי חולים בישראל, על אף שכיום מאושרים רק כעשרה אחוזים מסך הפינויים לטיפול רפואי מחוץ לעזה לעומת המצב לפני 7 באוקטובר 2023 — בעוד שמערכת הבריאות בעזה קורסת. העותרים הדגישו כי הפינוי למדינות שלישיות רחוק מלספק מענה לצורך ברצועת עזה.
ממדני בזמן הבחירות לראש העיר ניו יורק הבטיח כי יעצור את נתניהו אם יגיע לניו יורק. אך כידוע נתניהו חושב לבקר בניו יורק לדיון באו”ם. ממדני אמר שיתייעץ אם יש לו את הסמכות להורות על מעצרו של פושע המלחמה ובינתיים הודיע טראמפ שלא ניתן לעצור את נתניהו. אין התנהלות מבחילה זו מפתיעה. לאחר מלחמת העולם השנייה ארצות הברית והוותיקן סייעו לנאצים להגר לאמריקה הלטינית. ארגון בריחת הנאצים הבכירים כונה קו העכברושים”
